On July 28, 2017, the Senate took a vote on the Health Care Freedom Act, otherwise known as the “skinny repeal” bill. The skinny repeal was put forth by Senate Republicans and was attempting to repeal the individual mandate penalty. The bill also included a temporary repeal to the employer mandate penalty and sought to provide additional flexibility to states regarding various Affordable Care Act requirements.
John McCain, the Senate Republican from Arizona, cast the deciding vote, making the final count 49 to 51. Two other Republicans, Susan Collins of Maine and Lisa Murkowski of Alaska, also opposed the bill.
As a result, the ACA remains current law and employers should continue to remain compliant in all areas of the Affordable Care Act.
