On 6/2/2015, Emeryville, CA passed a paid sick leave ordinance that will take effect on 7/1/2015. The ordinance includes additional paid sick leave benefits beyond the state requirements under the California Healthy Workplaces, Healthy Families Act (AB 1522), including the following:

  • AB 1522 permits all employers to cap accrued paid sick leave at 48 hours, regardless of size. Pursuant to the Emeryville ordinance, employers may cap accrued paid sick leave hours at 48 hours for small businesses (55 or fewer employees within Emeryville city), and 72 hours for large businesses (56+ employees within Emeryville city).
  • AB 1522 permits employers to cap use of paid sick leave to three days per year. Pursuant to the Emeryville ordinance, employees may use up to the total number of paid sick leave hours accrued in each year of employment.
  • AB 1522 allows employees to use paid sick leave to provide care for a family member. Pursuant to the Emeryville ordinance, the definition of “family member” also includes a designated individual if the employee has no spouse or registered domestic partner. The Emeryville ordinance also allows an employee to use paid sick leave to provide care for a guide dog, signal dog, or service dog of the employee, the employee’s family member, or other person designated by the employee.
